Terms of Use Governing ILA Longshoremen’s Association Mobile App

The following Terms of Use (“Terms”) govern your use of the ILA Longshoremen’s Association software application (the “Application”) on your mobile device or other hardware. These Terms describe your rights and responsibilities and what you can expect from the Application.
Your use of the Application constitutes your acceptance of and agreement to these Terms. If you do not accept and agree to these Terms, do not use the Application.
The International Longshoremen’s Association, South Atlantic and Gulf Coast District (“ILA”) reserves the right to add, delete, and/or modify any of the terms and conditions contained in this Terms, at any time and in its sole discretion. ILA will use reasonable means to notify users of changes to these Terms, such as posting a notice on ILA’s website or emailing you a copy of or a link to the modified Terms.
In the event of substantive changes to this Terms, you may be notified by email. If a change to these Terms is unacceptable to you, your only remedy is to immediately cease use of Application. Your use of the Application following ILA’s notification of a change will constitute your acceptance of and agreement to the relevant changes.
1. The Application.
The Application is provided by the International Longshoremen’s Association, South Atlantic and Gulf Coast District (“ILA”) and allows you to access maritime news and events, keep track of job-related certifications, and receive other relevant information via your mobile device. In addition, if your paycheck is processed by a participating payroll services provider (“Payroll Services Provider”), you can view certain employment-related information.
2. Use of the Application.
You may not use the Application if you are under the age of 18. The Application is not intended for children under the age of 18 and children under the age of 18 are prohibited from using the Application.
Certain employment information is available through the Application, but only to users that receive a paycheck processed by a participating Payroll Services Provider.
3. Ownership and Proprietary Rights.
All material contained on, in, or available through the Application, including all information, data, text, music, sound, photographs, graphics and video messages, the selection and arrangement thereof, and all source code, software compilations and other material (collectively, the “Material”) are subject to copyrights and other proprietary intellectual property rights owned by or licensed to ILA. No rights in the Materials are granted to you except the licenses described in these Terms.
INTERNATIONAL LONGSHOREMEN’S ASSOCIATION® and all related trademarks, logos, and slogans are trademarks and servicemarks of ILA and/or its licensors. All rights in such trademarks and servicemarks are reserved.
4. Restrictions on Your Use of the Application.
You may not copy, distribute, modify, publish, or create other derivative works from, or make any commercial use of any information or Materials obtained from the Application except as expressly allowed under these Terms.
You may not reverse engineer, disassemble, or decompile any software in the Application or otherwise attempt to derive the source code of such software, except to the extent expressly permitted under applicable law. You may not engage in systematic retrieval of content or information from the Application to create or compile, directly or indirectly, a compilation, database, or directory.
You may upload a photo to use in connection with your user account. You may not upload any photo unless you own it or have secured the necessary rights to use it from the owner. The photo must comply with any guidelines provided in the Application. ILA reserves the right to delete any photos ILA in its sole discretion deems inappropriate for any reason. You retain ownership of any photo submitted by you. However, you hereby grant ILA and its licensors a non-exclusive, irrevocable, perpetual right and license to reproduce, digitally manipulate and re-format, store, and use any photo submitted by you in connection with the Application.
5. Licenses Granted to You.
Subject to these Terms, ILA grants you permission to access and use the Application from your mobile device and to electronically download, copy, or print hard copies of Materials from the Application solely for your own personal, non-commercial use. Any use of the Application or Materials other than for your own personal, non-commercial use is prohibited.
6. Location Restrictions.
The Application is intended solely for use while located in the United States, Canada, and/or Mexico.
If you use the Application in any location outside of the United States, Canada, and/or Mexico: (a) you represent and warrant to ILA that you are not subject to any government export controls or other restrictions applicable to your use of the Application; and (b) you represent and warrant to ILA that any information submitted by you to the Application while in such location will not cause ILA or its licensor's to become subject to the laws or regulations of any non-U.S. government or entity.
7. Passwords and Login Credentials.
You will choose or be provided with a user name and password (collectively, “Login Credentials”) in order to access the Application. You must treat your Login Credentials as confidential and cannot disclose them to any third party. Your Login Credentials cannot be used to provide a third party with access to the Application. You will be responsible for all activities occurring under your Login Credentials and you agree to notify ILA immediately if you become aware of any unauthorized use of your account.
8. Suspension of Application Access.
Access to the Application may be suspended or withdrawn from you individually or from all users, temporarily or permanently, at any time and without notice. ILA may impose restrictions on the length and manner of usage of any part of the Application for any reason.
ILA has the right to disable your Login Credentials at any time if ILA, in its sole and absolute discretion, believes you have failed to comply with these Terms. If ILA disables your account or imposes other restrictions on you for any reason, you must not attempt to use the Application under any other name, using another person’s Login Credentials, or on any other mobile device.
9. Third Party Websites.
ILA has no control over the content of any website or mobile application that is linked from the Application (unless ILA provides a link to its own website). Links to websites and mobile applications are provided “as is” for your convenience only. The terms and conditions, terms of use, and privacy policies of those third party websites and mobile applications will apply to your use of those websites and mobile applications and any transactions you enter into via such websites and mobile applications.
10. Privacy
ILA will only use your personal information in accordance with the terms of our Privacy Policy. You can review our privacy policy here. By using the Application, you agree to ILA's collection, use, and disclosure of your personal information in accordance with the Privacy Policy.
11. No Warranties.
Though ILA makes reasonable efforts to provide accurate, useful information through the Application, the information contained in the Application may contain errors or inaccuracies. ILA has no obligation, but reserves the right, to correct any errors, inaccuracies, or omissions and to change or update information at any time.
ILA makes no representation or warranty, express or implied, that your access to the Application will be uninterrupted or error-free, or that information and materials on the Application are accurate, complete, up-to-date, or fit for any particular purpose.
12. Limitation of Liability.
ILA shall have no responsibility or liability for (i) the accuracy or completeness of any information provided by Payroll Services Providers, or (ii) possessing, disclosing, or providing access to data or information provided by a Payroll Services Provider.
In no event shall your liability or the liability of ILA arising under or related to your use of the Application, Materials, or any content or information provided by or in connection with the Application exceed one hundred dollars ($100).
